Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Kondu platform operated by Kondu AI ("us", "we", or "our").
1 Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2 Description of Service
Kondu is a workflow orchestration platform that enables users to:
- Design and execute automated communication workflows
- Connect and coordinate AI processing agents
- Route messages across multiple channels (email, SMS, chat, webhooks)
- Monitor workflow execution and job status
Important: Kondu operates on a "content by reference" model. We orchestrate workflows using references to your content (URIs), but we do not store or process the actual content of your communications.
3 Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4 Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Send spam, unsolicited communications, or bulk messages
- Transmit malware, viruses, or harmful code
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any systems
- Harass, abuse, or harm another person or entity
- Violate intellectual property rights of others
- Process data in violation of privacy laws (GDPR, CCPA, etc.)
5 Your Content and Data
5.1 Ownership
You retain all rights to your content and data. We do not claim ownership of any content you process through the Service.
5.2 Your Responsibilities
You are responsible for:
- Ensuring you have the right to process any content through the Service
- Compliance with applicable data protection laws
- The security and backup of your content in your own storage systems
- Obtaining necessary consents from your end users
5.3 Data Processing Agreement
For enterprise customers processing personal data, we offer a Data Processing Agreement (DPA) upon request. Contact legal@kondu.ai.
6 Third-Party Services
The Service may integrate with third-party services (AI providers, storage providers, communication channels). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.
7 Fees and Payment
Certain features require payment. By selecting a paid plan, you agree to pay the applicable fees. Fees are non-refundable except as required by law or as specified in your service agreement.
8 Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice when possible. We reserve the right to modify or discontinue features with reasonable notice.
9 Intellectual Property
The Service, including its original content, features, and functionality, is owned by Kondu AI and protected by international copyright, trademark, and other intellectual property laws.
10 Limitation of Liability
To the maximum extent permitted by law, Kondu AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.
11 Indemnification
You agree to indemnify and hold harmless Kondu AI from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12 Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.
13 Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.
14 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Norway.
15 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
16 Entire Agreement
These Terms constitute the entire agreement between you and Kondu AI regarding the Service, superseding any prior agreements.
